# Terms of Service

> The agreement between you and INTERPLORE LLC for using hexodic.

The terms that govern using hexodic: the licence, purchases and billing through Apple and Google, tokens and rewards, acceptable use, age requirement, and how disputes are handled.

These Terms govern your use of **hexodic** — the game, the apps, and this website — published
by **INTERPLORE LLC**, a Michigan limited liability company ("we", "us"). By using hexodic you
agree to them.

## 1. Your licence to use hexodic

We grant you a personal, non-exclusive, non-transferable, revocable licence to use hexodic for
your own non-commercial entertainment.

Apps installed from the **App Store** are additionally governed by Apple's Standard End User
Licence Agreement, and apps installed from **Google Play** by the Google Play Terms of Service.
Where those store terms conflict with these Terms for an app obtained from that store, the
store's terms prevail for that app.

## 2. Accepting these Terms

By downloading, installing, or using hexodic, you accept these Terms. If you do not accept
them, do not use hexodic. If we change them we will update the effective date above and, for
material changes, give notice in the app.

## 3. Purchases and billing

Any purchase is processed by **Apple** or **Google** through their own stores under their
terms. **We never receive or hold your payment details.**

**Refunds are handled by the store you purchased from**, under that store's refund policy —
not by us. We can help you identify a purchase, but we cannot issue a store refund.

Purchases unlock in-game content. They do not confer ownership of anything, and they do not
give a competitive advantage in ranked play.

## 4. Tokens, rewards, and no real-money gaming

hexodic uses in-game tokens and may offer rewards for play, such as arena challenges.

**Tokens and rewards have no monetary value.** They cannot be exchanged, redeemed, transferred,
or cashed out for money or anything of real-world value, and hexodic provides no mechanism to
do so. They exist only inside the game, and we may adjust or discontinue them.

**We do not operate real-money wagering or betting.** You cannot stake money on a match.

If we ever introduce a feature that changes this, we will update these Terms, the
[Privacy Policy](/privacy), and our app-store disclosures **before** it ships.

## 5. Online play

Where online play against other people is available, you are responsible for your conduct
towards them. See §6.

## 6. Acceptable use

You agree not to:

- cheat, use bots, automate play, or exploit bugs to gain an unfair advantage;
- reverse-engineer, decompile, or tamper with the game or its network traffic, except where
  that right cannot lawfully be restricted;
- harass, abuse, threaten, or impersonate anyone, or choose a display name that does so;
- attempt to disrupt, overload, or gain unauthorised access to our systems;
- use hexodic for any unlawful purpose.

We may suspend or terminate access for breach of these rules.

## 7. Intellectual property

hexodic, including its name, artwork, sounds, board design, rules presentation, and software,
is owned by **INTERPLORE LLC** and protected by intellectual property laws. Your licence under
§1 grants no ownership. You may capture and share gameplay footage and screenshots for
non-commercial purposes such as reviews, streams, and social posts.

## 8. Your data

What we collect, why, and how to remove it is set out in our **[Privacy Policy](/privacy)**,
which forms part of these Terms. You can delete your account at any time — see
**[delete your account](/delete-account)**.

## 9. Age requirement

hexodic is intended for a general audience and is **not directed at children under 13**,
consistent with our [Privacy Policy](/privacy). If you are under the age of majority where you
live, you may use hexodic only with the involvement of a parent or guardian.

## 10. Availability

We provide hexodic on an ongoing but not guaranteed basis. Features, including online services,
may change, be interrupted, or be discontinued. Parts of the game are playable offline; online
features require a connection and may be unavailable at times.

## 11. Disclaimers and limitation of liability

To the fullest extent permitted by law, hexodic is provided **"as is" and "as available"**,
without warranties of any kind, whether express or implied, including implied warranties of
merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our total liability arising out of or relating to
hexodic will not exceed the greater of **(a)** the amount you paid us in the twelve months
before the claim, or **(b)** **USD $100**. We are not liable for indirect, incidental, special,
consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill.

**Nothing in these Terms limits liability that cannot lawfully be limited** — including, where
applicable, liability for death or personal injury caused by negligence, for fraud, or under
consumer-protection laws that give you rights which cannot be waived. Some jurisdictions do not
allow certain exclusions, so parts of this section may not apply to you.

## 12. Termination

You may stop using hexodic at any time and delete your account (§8). We may suspend or
terminate your access if you breach these Terms or where we are required to by law. Sections
that by their nature should survive termination — including §7, §11, and §13 — do so.

## 13. Governing law and disputes

These Terms are governed by the laws of the **State of Michigan, USA**, without regard to its
conflict-of-laws rules. Courts located in Michigan will have jurisdiction, except where the law
where you live gives you the right to bring proceedings in your local courts — in which case
that right is unaffected.

**There is no mandatory arbitration clause and no class-action waiver in these Terms.**
